Terms of Use
Last updated: June 21, 2026
These Terms of Use (“Terms”) govern your access to and use of the PillCount mobile application (the “App”), including any related services, features, and in-app purchases provided by Shannon Chowdhury (“PillCount,” “we,” “us,” or “our”). By downloading, installing, creating an account, or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.
1. IMPORTANT MEDICAL, SAFETY & ACCURACY DISCLAIMERS (READ CAREFULLY)
1.1 Not a medical device; no medical advice. The App is a general-purpose counting and productivity tool. It is not a medical device, a diagnostic tool, or a substitute for professional medical or pharmaceutical advice, diagnosis, treatment, or dispensing. The App does not identify medications for the purpose of treatment, does not recommend any medication or dose, and does not create a pharmacist–patient, doctor–patient, or any clinical relationship between you and PillCount or its operators.
1.2 AI-generated counts and appearance-level detection are estimates and may be wrong. The App uses an automated image-recognition model (machine learning / AI) and a device camera to estimate the number of objects (including pills) in an image and to detect appearance-level differences (such as color, shape, or size) between detected objects. These outputs are estimates and may be inaccurate, incomplete, or entirely incorrect. The model can miscount, fail to detect items, or fail to distinguish between visually similar or visually identical medications. Lighting, camera angle, image quality, overlapping items, and other conditions can affect accuracy.
1.3 The App does not identify specific medications. The App does not, and cannot, identify the specific medication, dose, active ingredient, NDC, manufacturer, or brand of any pill. Two different medications may share the same appearance (color, shape, size) and the App cannot distinguish between them. Any classification label shown in the App reflects appearance category only, not drug identity.
1.4 Do not rely on the App for clinical, dispensing, or safety decisions. You must independently verify any count produced by the App before using it for any purpose that could affect health, safety, dosing, dispensing, billing, inventory, compliance, or any medical or legal decision. Do not use the App as the sole basis for administering, dispensing, ingesting, withholding, or returning any medication. PillCount disclaims all responsibility for any decision made in reliance on App output.
1.5 Your responsibility. You are solely responsible for how you use the App and for any consequences of relying on its output. If you are a licensed pharmacist, pharmacy technician, or other regulated professional, nothing in the App overrides your professional, legal, or regulatory obligations, including those imposed by your state or provincial board of pharmacy and applicable pharmacy practice acts.
1.6 Scope acknowledgment. During onboarding, you affirmatively acknowledged that the App is an assistive tool that detects appearance-level differences between pills and does not replace pharmacist verification. That acknowledgment is incorporated into these Terms by reference. If you do not agree with the scope described in this Section 1, you must stop using the App and uninstall it.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the App. If you are using the App on behalf of an organization, you represent that you are authorized to bind that organization.
3. Accounts
You may need to create an account or be assigned an identifier. You are responsible for maintaining the confidentiality of any credentials and for all activity under your account. You may not share or transfer your account.
4. Subscriptions, In-App Purchases & Billing
4.1 Billing through Apple. PillCount Pro subscriptions (“Pro”) and any other in-app purchases are billed and processed by Apple (Apple Inc.) through the App Store, not by us. Your purchase is subject to Apple’s media terms and the Apple App Store terms of service.
4.2 Auto-renewal. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price. You can manage or cancel subscriptions at any time in your device’s Settings → Apple ID → Subscriptions.
4.3 Free trial. If a free trial is offered, you will be charged at the end of the trial unless you cancel before it ends. Subsequent renewal prices are as shown in the App at the time of purchase.
4.4 Refunds. Refunds are handled by Apple according to its policies; we do not control and cannot issue refunds for App Store purchases.
4.5 Entitlements via RevenueCat. Subscription status and entitlements may be managed through our service provider RevenueCat. Your subscription data is processed as described in the Privacy Policy.
5. Acceptable Use
You agree to comply with the Acceptable Use Policy, which is incorporated into these Terms by reference. In summary, you will not: (a) use the App for any clinical, dispensing, dosing, or safety decision without independent professional verification; (b) misrepresent App output as verified or accurate; (c) reverse-engineer, scrape, or abuse the App; or (d) use the App in violation of law or these Terms.
6. Privacy & Your Data
Our collection and use of personal information is described in our Privacy Policy at https://xeonmobius.github.io/pillcount-web/privacy.html, which is incorporated into these Terms by reference. If the App handles any health or identifying information, additional terms and legal obligations may apply.
7. Licenses & Intellectual Property
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your internal/personal or internal business use in accordance with these Terms. We (or our licensors) retain all right, title, and interest in and to the App, including all intellectual property. You may not copy, modify, distribute, sell, lease, lend, reverse-engineer, decompile, or create derivative works of the App except as permitted by applicable law.
8. Third-Party Services
The App relies on third-party services, which may include Apple (App Store, StoreKit), RevenueCat, and Google (e.g., forms). We are not responsible for the acts, omissions, or availability of third-party services. Your use of those services is also subject to their terms.
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS, AND WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the App will be accurate, reliable, uninterrupted, or error-free. No advice or information obtained from the App creates any warranty not expressly stated here. Computer vision and AI models can produce incorrect results in all cases.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PILLCOUNT (OR ITS OWNER, EMPLOYEES, OR AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY, MEDICAL HARM, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO THE APP, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Because some jurisdictions do not allow the exclusion or limitation of certain damages, some of the above limitations may not apply to you.
Aggregate liability cap. To the extent permitted by law, our total aggregate liability arising out of or related to the App will not exceed the greater of (a) the amounts you have paid to us through the App in the twelve (12) months preceding the claim, or (b) CAD 50.
11. Indemnification
You agree to indemnify, defend, and hold harmless PillCount and its owner, employees, and affiliates from and against any claims, damages, losses, liabilities, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms; or (c) your reliance on App output, including any decision made on the basis of a pill count or identification produced by the App.
12. Dispute Resolution, Arbitration & Class-Action Waiver
12.1 Informal resolution. We will try to resolve disputes informally first. Contact us via our feedback form (below) before filing a claim.
12.2 Arbitration. Except for matters that may be taken to small-claims court, any dispute or claim arising out of or relating to the App or these Terms will be resolved by final, binding individual arbitration administered by the Alternative Dispute Resolution Institute of Ontario (ADRIO) under its then-current rules, in Ontario, Canada, and not in court.
12.3 Class-action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. Class arbitrations and class actions are expressly waived.
12.4 Governing law. These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-laws principles.
13. Modifications to These Terms
We may modify these Terms from time to time. We will indicate the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to the App at any time, for any reason, including violation of these Terms. Provisions that by their nature should survive (including disclaimers, limitations of liability, indemnity, and dispute resolution) survive termination.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and PillCount regarding the App.
